Certificate of warranty and conformity


Indira, online store operated by SC Indira Art Distribution SRL with headquarters in Str. Ghe Dem Teodorescu No. 11-13, Sc 1, Et 5, Ap 39,  Sector 3, Bucharest, with CUI RO 36408630, J40/10658/09.08.2016, holder of the Authorization issued by ANPC, No.: 9756 for carrying out operations with precious metals and precious stones, declares on its own responsibility, according to the provisions of art. 5 of GD no. 1022/2002 regarding the regime of products and services that may endanger life, health, occupational safety and environmental protection, that the silver and gold jewelry, marketed by the company, do not endanger life, health, occupational safety, do not produce a negative impact on the environment and are in accordance with EU norms.


All silver jewelry sold is verified and certified, has a purity of 92.5% and bears the mark of the ANPC - Metals and Precious Stones department according to the legislation, which guarantees the quality of the precious metal used, or the IND responsibility mark .

All gold jewelry sold is verified and certified, has a purity of 58.5% gold, and bears the mark of the ANPC - Precious Metals and Stones department according to the legislation, which guarantees the quality of the precious metal used, or the IND responsibility mark.

Natural stones may present small differences and imperfections in color or cracks, this is not a defect, it is their natural appearance.

Conditions for granting the guarantee

All conditions below are in accordance with the legislation in force regarding certain aspects relating to contracts for the sale of goods. GEO no. 140 / 28.12.2021.

APPLICATIONS
Any warranty-related request must be sent in writing to support@indira.ro and must include a picture of the product showing the defect, a picture of the Warranty Certificate issued based on the order placed and delivered, and an explicit description of how the defect occurred. If we do not receive the above, we will request it by e-mail. The response to the request will be given within 24-48 hours depending on the complexity of the problem.

NOTE: For products under warranty and requiring repairs, they will only be accepted if accompanied by the Warranty Certificate issued based on the order and after proof of its existence is provided via email. We reserve the right not to accept products that are not accompanied by the Warranty Certificate.

The warranty certificate issued based on the order is the obligation of the merchant given by GEO 140 / 28.12.2021 art. 15, paragraph (5)-(6)-(7), the buyer's obligation is to keep it until the end of the warranty period and compliance according to the legislation in force.

WHAT IS THE COMMERCIAL GUARANTEE CERTIFICATE (art. 15)
The commercial warranty certificate accompanies the online order purchased together with the tax invoice, a document sent to the e-mail from the order placed on the indira.ro website. The commercial warranty certificate covers the authenticity of the material, 925 silver, 585 gold, the closure systems, the method of manufacture and not improper use, breakage due to hanging, breakage resulting from the use of the products for sleeping, activities, household, fitness, running, etc. For more details, see Chapter. All products are verified by ANPC based on the authorization issued, which certifies the conformity of the material underlying the products on the site.

DELIVERY OF ORDERS
All INDIRA products are expertly tested before being sent to the Customer, analyzing:
if they have all the stones;
if it has scratches;
if the closures are good and do not get stuck;
if it shows changes in handling;
if it is bent;
Each INDIRA piece of jewelry is cleaned and handled gently while being placed in the box, before being sent to the customer.
After receiving the order, if the Customer believes that he has a product that does not comply with the above, he is asked to send a picture of the product and the defect found to the e-mail address: support@indira.ro, immediately.
If the Customer receives the product, starts using it and inadvertently hits it, scratches it, subjects it to mechanical shocks, he cannot claim its replacement, saying that this is how the product was delivered to him. Verification of the correctness of the complaint will also be made with the parcel deliverer, the time of delivery will be analyzed, the time of notification that the product was unsuitable upon receipt, the box in which it arrived will be analyzed, if it shows signs of damage, which could cause the product to be non-conforming.

GUARANTEE
All INDIRA products are delivered with care and with a commercial warranty corresponding to the legislation in force, OUG 140 of 28.12.2021, for a period of 2 years. Manufacturing defects will be repaired with care and free of charge, as long as the product complies with the warranty terms and conditions;
All repair requests will be subject to inspection and expertise by our team before the request is processed, by requesting additional information through the chosen communication method, e-mail.
If the INDIRA quality assurance team determines that the damage was not caused by a manufacturing defect, the customer will be notified and if repair services are available at a cost.
If, following the expertise, it is found that the product of the customer who requested the warranty repair is not due to any manufacturing defect, the customer does not want the product repaired for a fee, the round-trip shipping cost is his responsibility and is 30 lei and will be paid in cash upon receipt of the package;

WARRANTY TERMS AND CONDITIONS
The legal commercial guarantee is granted for a period of 24 months from the date of taking possession of the purchased products, and it certifies that the product is made of 925 silver or 585 gold, verified and marked by ANPC for products exceeding 2 g, and only verified by ANPC for jewelry under 2 grams, according to the legislation.
The commercial warranty does not cover wear and tear of the product, regardless of how long it has been in possession, deformations, scratches or any other form of accidental damage, misuse, negligence, unauthorized repairs/modifications/adjustments by third parties or even by the buyer, fireworks made to the products, massive wear, breakage, etc.;
For products plated with yellow gold or rose gold, the plating is 2 microns. The commercial guarantee is not granted for the plating. The preservation of the plating depends on the use of the jewelry and not on the veracity of the material. Massive wear (24h/24h) will lead to the cleaning of the plating. Cleaning the plating is not subject to the Commercial Guarantee granted according to the legislation in force GEO no. 140/28.12.2021.
Refunds cannot be requested for products that no longer correspond to the products delivered following orders placed, being broken, damaged, bent, worn, with traces of use, oxidized, lost, handled carelessly, etc.;
The commercial warranty does not cover normal wear and tear, oxidation and/or damage caused by loss, theft, improper use, accidents, negligent or intentional malicious handling.
The commercial warranty does not cover damage caused by moisture, loss of the jewelry's plating, cleaning the purchased jewelry in a way that leads to the loss of the plating;
If any part of the jewelry (including but not limited to stones, chains, clasps, etc.) falls off, it should be returned with its parts, before any attempt is made to repair it. INDIRA does not assume responsibility for missing parts or stones.
The commercial warranty is not granted for: discoloration, change in product color due to exposure to chemicals, makeup, swimming pools, hot tubs, baths, chemical and toxic environments, moisture;
The commercial warranty is not granted for scratches, bends, jewelry catches, damage in the area of ​​the claws that hold the stones, due to negligence or other damage;
The commercial guarantee is not granted for lost or stolen products;

CORRECTIVE MEASURES IN CASE OF NON-CONFORMITY (art. 11 of GEO 140 / 28.12.2021)
If the jewelry cannot be repaired, we can replace the defective jewelry with a similar model, another model of the same value or we can refund its value. According to OUG 140 / 28.12.2021, the warranty consists of the free remedy of deficiencies that occurred to the products within the warranty period and which are not attributable to the consumer. The consumer's rights are in accordance with OUG 140 / 28.12.2021. The consumer's rights are not affected by the warranty conditions provided in this Warranty Certificate.

REPAIR AND REPLACEMENT OF GOODS (art. 12 of GEO 140 / 28.12.2021)
In the event that during the warranty period, a product has a manufacturing defect: the lock is blocked, a stone falls, other defects (not related to improper use), it will be subject to a specialized examination and the defect will be repaired free of charge, cf. paragraph (1) letter a.
The repair period will not exceed 15 calendar days from the moment the seller was informed by the consumer about the non-conformity of the product.
The product sent for repair will be accompanied by the Warranty Certificate, based on which a repair and finding sheet will be issued, which will highlight the name of the repaired product, the defect, the solution, and the warranty applied to the repair, the date of exit from service and the date of entry into service.
Products accepted for repair will be brought to the same level of conformity as the product delivered following the order, and will be handed over together with the Repair Sheet. Any repair made to the product will have a 14-day warranty.
If the defect recurs within 14 days, the product will be re-examined and the problem will be remedied. If the product defect recurs after the warranty period granted for the repair, the product will no longer be subject to examination, as the defect is due to improper use and not a manufacturing or material defect.

RECOMMENDATIONS FOR USING INDira JEWELRY
For products plated with yellow, white, rhodium, rose gold, greater care is recommended to preserve the color for a long time. Fading of the plating depends strictly on each individual use, so it is not recommended: using gold-plated jewelry in direct contact with water for a long time, bringing the product into contact with destructive environments, dust, smoke, solvents, adhesives, acids, salts, etc.

Normal, natural wear and tear of a plated product means that the color will fade over time, or that the color will fade in places, without causing any defects in the base material. Yellow gold plated products do not behave like products made from pure 14k, 18k or 24k gold. For gold plated rings, they will fade faster than gold plated chains or gold plated earrings.
According to law 449/2003, art.11 paragraph 2, the buyer cannot request the replacement of the jewelry due to the stones falling out. Any repair to the products within the warranty period will be carried out free of charge or the product will be replaced, under the conditions of OUG 140 / 28.12.2021 revised, if it is confirmed that a defect in material or workmanship was the cause of such damage, rather than improper use of the product by the buyer.
