Black Friday Contest Rules

 

1. Art. 1 Organizer of the Contest

   1.1. Indira Art Distribution LLC, located at Str. Intrarea Moneasa, Nr 1, et. 1, ap 4, postal code 010633, Bucharest, organizes the Black Friday contest from October 31 to November 2.

   1.2. These rules constitute the entirety of the conditions and standards established by Indira Art Distribution LLC, the organizer of the Black Friday contest regarding its organization and conduct.

   1.3. Indira holds all rights and obligations arising from its status as contest organizer. The organizer reserves the right to modify the concept and format of the contest whenever deemed necessary, while notifying the public by any means.

   1.4. The current concept and format of the contest are protected by copyright held by the organizer, according to the provisions of Law No. 8/1996 regarding copyright and related rights.

   1.5. The contest rules will be available on the website www.indirabijoux.com

   Article 2. Contest Organization. Contest Mechanism.

   2.1. The contest titled "Black Friday" takes place from October 31 to November 2 on the Organizer's Instagram page (https://www.instagram.com/theofficialindira)

   2.2 On October 31, 2025, the organizer will post the contest announcement image on their Instagram page.

   To participate in this contest, each participant must create an account, add the desired jewelry to their wishlist, and subscribe to the newsletter. The contest ends on November 2, 2024, at 7 PM, and on the following days, the winner will be announced by the Indira team during a draw. The winner will receive the prize offered by the organizer.

   Article 3. Participants in the Contest

   3.1 Any individual proofing a domicile or residency in the USA, who is at least 14 years old by the date of registration for the contest, can participate in the "Black Friday" Contest.

   3.2 By entering the "Black Friday" Contest, each participant agrees to accept all the contest rules unconditionally.

   3.3. Employees and contracted collaborators of the organizer, their close relatives up to the 2nd degree, as well as employees and their close relatives of third-party companies or foundations involved in promoting the project represented by the "Black Friday" contest cannot participate.

   Article 4. Value and Award Distribution of the Contest

   4.1 The prize for the "Black Friday" contest organized by Indira consists of silver jewelry worth 339 USD. The value of the silver jewelry will be the current price, not discounted.

   4.2 The total value of the awarded prizes is approximately 339 USD.

   4.3 The winner of the contest will be checked for a valid email address and for compliance with the contest rules. The potential winner must respond to the Organizer's message within 72 hours after the announcement of the winner. If the potential winner does not respond to Indira's notification within the allotted time, or if the email is invalid, a new winner will be drawn. The alternative winner will be contacted by direct message and must respond to the Organizer's notification within 72 hours after the announcement of the won prize.

   4.4 The contest winner will receive silver jewelry at the current price (with no discount applied), worth 339 USD.

   4.5 Delivery of prizes may take up to 4 weeks. The Contest Organizer reserves the right to replace a prize with an equivalent value at its discretion unless prohibited by law. The Contest Organizer may disqualify a winner and select another randomly if the prize has not been claimed. Prizes are not transferable and their monetary value cannot be claimed. The Organizer is not obliged to replace the prize at the winner's request if the size does not fit or if the product does not meet the expectations.

   Article 5. Taxes and Duties

   5.1 Prizes awarded under this "Black Friday" contest are subject to taxes and duties according to the rules established by the U.S. tax code or the conditions set out in any Tax Treaties signed between the USA and other countries, in the case of winners who are dual citizens, one of whom is American.

   5.2 The Organizer of the "Black Friday" contest is required to withhold at the source and pay the taxes established according to the U.S. tax code and any mentioned Tax Treaties.

   5.3 The organizer will cover the taxes and duties established according to the tax code for awarded prizes.

   5.4 By participating in this contest, the Participant (i) waives all rights to any material submitted by the participant concerning this contest (including any moral and copyright rights); (ii) agrees and acknowledges that submissions (including material submitted by the participant in relation to the contest) become the property of the Organizer and will not be returned; and (iii) guarantees the Organizer the absolute right to edit, modify, publish, exploit, and use the submission, voice, actions, likes, name, biographical material, written works, as well as any other information or materials that the participant provides or may be made available through the contest in any type of media, now known or invented in the future, and in any manner, without further approval.

   5.5 The Organizer reserves the right to verify the accuracy or truthfulness of any information contained in any contest submission. The Organizer has the right, at its discretion, to determine whether a submission is inappropriate to be published on the site or for any other public dissemination and whether it complies with the Contest Rules. The Organizer reserves the right to disqualify any contest submission if it believes there are valid reasons or suspicions in this regard. The Organizer's decisions are final and binding concerning all aspects related to this Contest.

   Art. 6. Limitation of Organizer's Liability:

   6.1 The Contest Organizer and its respective affiliates, subsidiaries, parent companies, advertising and promotion agencies, as well as all employees, shareholders, are not responsible for: any incorrect or inaccurate information in submissions; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of the telephone network, online computer system, computer equipment, servers, suppliers, or software, including any damage or deterioration to the participant's computer or any person regarding inability to participate in this Contest; inability to access the site or to download information or data; theft, manipulation, destruction or unauthorized access to contest entry data that are processed late or incorrectly or incompletely, or loss of phone, computer or electronic failure or for any other reason; printing errors; or any combination of these. Proof of data or information upload and entry onto the site is not considered proof of delivery or receipt. Illegible, duplicate and incomplete entries will be disqualified. Fraudulent, misleading or false entries render participants ineligible, and all related submissions or votes will be considered void.

   6.2. As a condition of participating in the Contest, participants release the Organizer and its subsidiaries from any liability for losses, damages, injuries, harms, costs, or expenses, including any type of property damage, bodily injury, and death that may occur in connection with participation in the Contest, possession, acceptance or use of the prize or participating in any activity related to promotion and claims based on publicity rights, copyright or copyright infringement, defamation or invasion of privacy and delivery of goods.

   Art. 7 Special Provisions:

   7.1 Potential winners are subject to verification by the Organizer. The Organizer's decisions are final and binding regarding all aspects related to the contest. Potential winners must comply with the Contest Rules, and receipt of prizes is conditioned upon meeting all its requirements. The Organizer is not responsible for any technical, material, or software failures, unavailable connections or incomplete computer transmissions or unforeseen changes related thereto, which may limit participants’ ability to enter the Contest, even due to the Organizer's negligence. The Organizer may, at its discretion, modify, cancel or suspend this contest due to viruses, unauthorized human intervention or other causes beyond the Organizer's control that could affect the proper conduct of the Contest, as initially set. The Organizer is not responsible for any changes to participants' contact information. Any false or modified entry compared to reality will not be accepted. The Organizer decides at its own discretion to disqualify any participant who does not comply with the Contest Rules or attempts to manipulate the functioning of the Contest or behaves in a manner detrimental to the Organizer, the Contest, or any other participant.

   7.2. The Organizer assumes no liability, which falls exclusively on the participants, for:

   7.2.1. Illegal appropriation by participants of uploaded photos and non-compliance with copyright;

   7.2.2. Situations where participants provide inaccurate or incomplete data making it impossible for the Organizer to contact the participant and therefore deliver the prize;

   7.3. Any complaints regarding the conduct of the Contest should be addressed to the Organizer's email address support@indira.ro until November 20, 2025. Subsequent complaints will no longer be considered.

   7.4 In accordance with the requirements of Law No. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, the Organizer processes the personal data of Participants as the data controller.

   7.5 By participating in the Contest, Participants explicitly and unequivocally agree that their personal data may be included in the Organizer's database for the purposes of validation, awarding of prizes, and the Organizer's tax obligations, as well as for sending Participants advertising and direct marketing communications. By participating in the contest, you express your consent for the Organizer to use the data provided by you for promoting the products and services of the Organizer, as well as partner companies, such as, but not limited to:

   - Sending advertising and marketing messages, as well as sending offers regarding services and products;

   - Sending by phone or SMS, mail or other electronic communication means (e.g., email) information regarding services and products;

   - Participation in various contests and other promotional marketing and advertising activities regarding certain services and products;

   - Improving products and services, to respond to your needs by providing news, case studies, and conducting opinion polls.

   This Contest is not sponsored, endorsed, administered, or associated with Facebook or Instagram.

   Art 8. Applicable Law

   8.1. These Rules constitute an agreement between the participant and the Organizer of the contest, governed by the applicable laws of the USA.
